This License Agreement is a legal agreement between you (either an individual or a single entity) and Grapsoft.com for the Bannersoft software product which includes computer software and may include associated media, printed materials, and "online" or electronic documentation (collectively, "Bannersoft Software"). By installing, copying, or otherwise using Bannersoft Software, you agree to be bound by the terms of this agreement.

Before purchasing Bannersoft, carefully read the following terms and conditions. Unless you have a different license agreement signed by Grapsoft.com your purchase of this software indicates your acceptance of this license agreement and warranty.

BY PURCHASING BANNERSOFT SOFTWARE YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY ITS TERMS AND SUBJECTS TO ITS CONDITIONS.

YOU FURTHER AGREE THAT THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE STATEMENT CONCERNING THE SUBJECT MATTER OF THE AGREEMENT BETWEEN GRAPSOFT.COM AND YOU, AND SUPERSEDES ANY PROPOSAL(S), OR PRIOR AGREEMENT(S), WRITTEN OR ORAL, RELATING TO THE SUBJECT MATTER OF THE AGREEMENT.

Bannersoft is licensed, not sold. Bannersoft is owned and copyrighted by Grapsoft.com. Your license confers no title or ownership in the Bannersoft Software and is not a sale of any rights in the Bannersoft Software. One licensed copy of the program may reside as one single instalation on a single server. For each installed instance of the program, a separate license is required unless you buy licence for unlimited intalations. Registered users may alter or modify this software, at their own risk.

Grapsoft.com or its suppliers in no event shall be liable for any indirect, incidental, special, or consequentual damages whatsoever (without limitations including damages for loss of business profits and or information, business interruption, or any other pecuniary loss) araising out of the use of or inability to use the Bannersoft software provide or the provision of or failure to provide support services, even if Grapsoft.com has been advised of the possibility of such damages.

Grapsoft.com is not and will not be held liable for any conduct associated with your use of this program, for your advertising activity, nor for any content posted using Bannersoft Software. The user must assume the entire risk of using Bannersoft. Grapsoft is not to be held, and will not accept any liability for any damages, direct or consequential, resulting from the installation or use of this software. This includes, but is not limited to, loss of stored data or loss of operational capability of the associated hardware and software systems.

No warranties. To the maximum extent permitted. Grapsoft.com and its suppliers disclaim all warranties and conditions, wheter express or implied; including but not limited to implied warranties of merhantability, fitness for a particular purpose, title and non-infringement with regard to the Bannersoft Software and the provision of or the failure to provide support services. This limited warranty gives you specific legal rights.

Grapsoft.com grants your company/individuality a license to use Bannersoft software. Users or license owners may not give non license holders access to or permission to modify the software. Although license-holders may modify the code for their use, modified code may NOT be resold or distributed. Furthermore, these notices, including "bannersoft" wording that appears online, must remain visible to the human eye. The Software is owned and copyrighted by Grapsoft.com or its third party suppliers. Your license confers no title or ownership in the Bannersoft and is not a sale of any rights of the Software. Grapsoft or third party suppliers may protect their rights in the event of any violation of these License Terms.

Grapsoft grants you a non-exclusive, limited license to modify Bannersoft Software for your own use. The modified software product shall not be made available for sale, resale, distribution or publication under any circumstances. Although you may customize the software as you like, you MAY NOT alter or remove the copyright and "powered by" notices throughout the system.

You may permanently transfer all of your rights under this agreement, provided you retain no copies, you transfer all of the Bannersoft Software (including all component parts, the media and printed materials, any upgrades and this Licence) and the recipient agrees to these Licence terms.

Bannersoft Software is not to be used for presenting irrelevant, misleading or Illegal Activities. Grapsoft.com reserves rights to cancel all product support and future updates without any monetary refund if you violate any of these terms and conditions.

Grapsoft.com may terminate your license upon notice for failure to comply with any of these License Terms and/or Conditions. Upon termination, you must immediately destroy Bannersoft, together with all copies, adaptations and merged portions in any form.

It is your responsibility to check servers specifications prior to placing your order. License fees for Bannersoft Software are non refundable. Check pricing from our main page. The customer is responsible for determining if the product is suitable by using the fully functioning online demos and reading dotumentation at www.grapsoft.com prior to ordering. Refunds are not given for missing features or capabilities of Bannersoft Software which feature fully functional online demos. Refunds are not given for inability to meet hardware or software requirements for which the requirements are clearly listed on the website and instructions are provided. Refunds are NOT given for any of the fees. If you have problems installing the license software, we will provide you will free support.
